In 1905, the Court ruled in Jacobson v. Massachusetts that local health authorities could compel adults to receive the smallpox vaccine under a state law. The majority held that states have police powers to pass laws that protect the “health, safety, and general welfare of the public,” and that it is for the state legislature to decide whether or not vaccination is the best way to protect public health. In the subsequent 1922 case, Zucht v. King, the Supreme Court relied on its decision in Jacobson to support its conclusion that it is within state’s police power require vaccinations. At the federal level, the vaccine mandate becomes more complicated. Under the Act, The Department of Labor may issue an Emergency Temporary Standard if it determines that (1) “employees are exposed to grave danger from exposure to substances or agents determined to be toxic or physically harmful or from new hazards,” and (2) “such emergency standard is necessary to protect employees from such danger.” When OSHA issues an Emergency Temporary Standard, it can remain in effect for up to six months without enduring the normal review and comment process of rulemaking under the Act. Opponents of President Biden’s recent executive order argue that states, not the federal government, are tasked with protecting public health within states. House Republicans have argued that the mandate infringes on Americans’ individual rights and oversteps the reach of the federal government’s powers. The Supreme Court’s interpretation of Tenth Amendment issues makes clear that congress cannot commandeer state legislatures. The Court held in New York v. United States and Printz v. United States that the federal government cannot coerce states into using their own resources to carry out federal policies. This is likely why the SC has thus far stayed the previous cases: they were brought by groups against a state mandate. Biden's latest move is a whole other can of worms. BTW, I'm not an anti-vaxxer, though I haven't gotten any of the vaccines. Why? First, because I'm not convinced they do anything to protect people and the potential adverse effects are far more concerning. Second, there are other methods available to deal with COVID, and more coming. Third, I'm a recluse, because most people get on my nerves. But I don't hate them. I don't judge them. I don't consider them to be lesser human beings because their beliefs are different. And I certainly don't wish them ill will. Take a chill pill.

We know that the #s from last year are conflated and include deaths where Covid was not necessarily the primary cause, especially in older people. As it stands, there are other methods--including at least one that the government refuses to recognize--and other promising methods to treat the illness at early onset--that need to be explored further and made available to people without trying to shove something into our arms just because a crackpot who screwed up AIDS and tortured puppies says so.   6. Actually, Reuters is mischaracterizing what the court did. It issued a stay for both the Maine and NY challenges. From Cornell Law School: Stay of Proceedings A ruling by a court to stop or suspend a proceeding or trial temporarily or indefinitely. A court may later lift the stay and continue the proceeding. Some stays are automatic, but others are up to judicial discretion.

  13. IMO, the whole thing about last night was for Wendy to introduce the general population to her country music creds. And I'm convinced Blake already knew Wendy, maybe as more of an acquaintance, but he wasn't totally unaware of her existence. It doesn't matter, in the long run, whether they knew each other outside of the show. Wendy would flourish on anyone's team. And it's a given that she deserves to win, because no one else has the power and the glory, amen amen However, I don't think that NOT winning would stop her from gaining traction in the industry. I'd love to see her and LiBianca in the finals....
